A UK Court of Appeals dismissed yesterday Chobani’s appeal against a 2013 judgment in the long-running dispute with Fage regarding the label “Greek yoghurt.” The Court ruled in favour of Fage, finding that Greek yoghurt had to be made in Greece and also refused Chobani’s permission to appeal to the Supreme Court.

The 2013 initial judgment by Justice Briggs stated that “… the use of Greek yoghurt to describe yoghurt not made in Greece plainly involves a material misrepresentation…” since (…) in fact, a substantial proportion of those who buy Greek yoghurt in the UK … think that it is made in Greece. Following the Court of Appeal’s decision, a permanent injunction against Chobani has been upheld prohibiting it from marketing its yoghurt as Greek. The company has also been ordered to pay FAGE’s court fees.
